Terms of Service

These Terms govern your use of Vietop Dictation (the “Service”), an English listening and speaking practice platform operated by Vietop English Center (“Vietop”, “we”, “us”). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility and accounts

You may use the Service if you can form a binding agreement with us and are not barred from doing so under applicable law. If you are below the age at which you can consent to data processing in your country, you must have permission from a parent or guardian.

Learners sign in with a Google account. Staff accounts are provisioned by Vietop. You are responsible for activity under your account and for keeping your sign-in method secure.

2. Video content and third-party rights

Vietop selects publicly available third-party videos — principally from YouTube — and configures them as shadowing and dictation exercises for its learners. These videos are embedded and streamed from their original platform; the Service does not host, copy, download or redistribute them.

All videos, audio, images and associated material remain the property of their original creators and rights holders, and we claim no ownership of, or affiliation with, that content. Video playback is subject to the terms and policies of the platform serving it, including YouTube’s Terms of Service.

Transcripts and per-line timings are prepared or corrected by Vietop staff for the sole purpose of language study, and are shown alongside the video for that purpose. Where a video has an existing caption track, it is used as a starting point only.

If you are a rights holder and believe material has been used improperly, contact us using the details in section 9 and we will review and, where appropriate, remove the exercise promptly.

3. Your recordings and practice data

Shadowing exercises record your voice so you can play the take back and so it can be scored. Recordings you save, together with your scores and practice history, remain yours; you grant Vietop permission to store and process them in order to provide the Service, show your progress, and let your teachers review your work.

Live pronunciation scoring uses speech recognition built into your browser. On some browsers this means audio is processed by the browser vendor’s servers. Deleting your account removes your recordings as described in the Privacy Policy.

4. Study programs

Programs are created by Vietop staff. Public programs are open to any learner; private programs are joined with a code issued by a teacher. Access to a program may be changed or withdrawn by staff at any time.

5. Achievements

Vietop staff may award badges recognising a learner’s work. Achievements are a form of recognition within the Service only. They carry no monetary value, confer no qualification or certification, and may be amended or withdrawn by staff.

6. Acceptable use

• Do not misuse, disrupt, overload, or attempt to break the Service.
• Do not attempt to access accounts or data that are not yours.
• Do not attempt to download, capture, or redistribute video content made available through the Service.
• Do not use the Service for unlawful or infringing purposes.
• Do not upload material you do not have the right to use, or content that is unlawful, offensive, or harmful to others.

7. Ownership

Vietop Dictation, its name and branding, together with the teaching material, transcripts, exercise configurations and study programs prepared by Vietop staff, are the property of Vietop.

The underlying platform software and infrastructure were developed by D&A Softworks and are licensed to Vietop under a commercial agreement; ownership of that software remains with its developer. Nothing in these Terms grants you any right to copy, modify, decompile, reverse engineer, resell, sublicense, or create derivative works from the Service or any part of it. All rights not expressly granted are reserved by their respective owners.

8. Availability, termination and liability

The Service is provided on an ongoing basis but is not guaranteed to be uninterrupted or error-free. Exercises, programs and features may be added, changed or removed, and planned maintenance may occasionally make the Service briefly unavailable.

You may delete your account at any time from your profile page. Vietop may suspend or terminate access where these Terms are breached. On deletion, your personal data is removed as described in the Privacy Policy.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, and we make no guarantee as to any particular learning outcome. To the fullest extent permitted by law, neither Vietop nor its platform provider shall be liable for any indirect, incidental, special or consequential loss arising out of your use of, or inability to use, the Service. Nothing in these Terms excludes liability that cannot lawfully be excluded.

9. Changes to these Terms and contact

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance of the updated Terms. Questions about these Terms, or about content used in the Service, can be sent to daotao@vietop.edu.vn.
